Terms of Service

Last updated October 13, 2026.

These Terms of Service (“Terms”) govern your use of the website, services and communications of Foreman Marketing, a brand of Blashton LLC, a Tennessee limited liability company doing business as Foreman Marketing (“Foreman Marketing,” “we,” “our,” “us”). By using our website or booking pages, engaging us for services, or giving us your contact information, you (“you,” “client”) agree to these Terms. If you do not agree, please do not use our services.

1. Our services

Foreman Marketing provides marketing services to home-service contractors, including:

  • Website builds, hosting and maintenance.
  • Local search (SEO), Google Business Profile and business listings management.
  • Content written to be found and cited by AI search tools.
  • Advertising management on Google (including Local Services Ads), Meta and Yelp.
  • Call tracking, and matching calls and leads to the client's own customer records.
  • Review requests and reputation work.
  • Follow-up and workflow automation set up inside the client's existing software.
  • Social media management and reporting.

Anything not listed above is out of scope. Where a need falls outside our scope (for example, replacing an existing CRM, quoting or estimating software, field-service software setup, point-of-sale integration, vehicle wraps or direct mail), we may refer or recommend, but we do not deliver it as part of our services.

2. Engagements and payment

Deliverables, timelines, exclusivity, pricing and any guarantee are set out in a written engagement agreement signed by both parties. These Terms apply to every engagement but do not by themselves create a service obligation; that obligation comes only from a signed engagement. Unless your engagement says otherwise:

  • Invoices are due on receipt unless a payment schedule is set out in the engagement.
  • Late payments may incur a service charge of 1.5% per month on outstanding balances, to the extent the law allows.
  • We may pause services on accounts more than 30 days past due.
  • Advertising budgets, third-party platform fees, software subscriptions and other pass-through costs are billed separately from our fees, unless the engagement bundles them.

3. Guarantees and exclusivity

Where an engagement includes a guarantee, its metric, measurement window, conditions and remedy are written into the engagement before you sign. Our guarantee remedy is a check, or a credit if you prefer, in the amount stated in your engagement.

We work with one company per trade in each market, as defined in your engagement, and we do not take on a competing company in that market during your term.

4. Your responsibilities

  • Give us timely access to the accounts, assets and approvals we need, such as domain and DNS, advertising accounts, call tracking, your CRM and decision-maker availability.
  • Keep any advertising budget your engagement requires.
  • Review deliverables within the time windows in your engagement.
  • Pay invoices as set out in your engagement.
  • Use our work in line with applicable law and platform rules, including advertising platform policies and consumer-protection laws.

Delays caused by missing access, slow approvals or third-party issues may extend timelines and are not our responsibility.

5. Intellectual property

  • What you and we already own: each party keeps ownership of intellectual property it owned or developed before the engagement.
  • Work product: once fees are paid in full, ownership of final deliverables made specifically for you (for example, custom copy, custom website code and brand-specific creative) passes to you. Underlying tools, components, frameworks, methods and pre-existing materials stay ours and are licensed to you on a non-exclusive, non-transferable basis for the purpose of the engagement.
  • Case studies: we may describe the engagement and its results in our case studies and marketing. We do not publish your business name or logo without your written permission.

6. Confidentiality

Each party will protect the other's non-public business and customer information with the same care it uses for its own, and will not disclose it except to deliver the services or as required by law. This survives the end of any engagement.

7. Text messages and email

How you opt in. Our booking forms have two separate checkboxes, one for appointment text messages and one for marketing text messages. Both start unchecked and both are optional. You can book a call without checking either, and consent is not a condition of purchase.

  • Appointment messages: confirmations, reminders, rescheduling and follow-ups about a call you booked with Foreman Marketing.
  • Marketing messages: case studies, offers and updates about our services, sent only if you checked the marketing box.
  • Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • Reply STOP to any text to opt out and HELP for help, or email blake@advocate1917.com.
  • Email recipients can unsubscribe from marketing email at any time with the link in any message.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how we handle your information.

8. Warranties and disclaimers

We will perform our services with reasonable care and skill, consistent with industry standards.

Except as expressly stated in a signed engagement, all services and deliverables are provided “as is,” without warranty of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that our services or third-party platforms will be uninterrupted, error-free or achieve any particular result, except where a guarantee is written into a signed engagement.

Advertising results depend on each platform's rules, algorithms and policies, which can change without notice and are outside our control.

9. Limitation of liability

To the maximum extent the law allows, our total liability arising out of or related to our services or these Terms will not exceed the fees you paid us in the three (3) months before the event that gave rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or lost business opportunities.

10. Indemnification

You will indemnify, defend and hold harmless Foreman Marketing and its officers, members, employees and contractors from claims, damages and expenses (including reasonable attorneys' fees) arising from: (a) content, data, products or services you supply to us or tell us to use; (b) your breach of these Terms; or (c) your violation of law or of a third party's rights.

11. Term and termination

Engagements run for the term in your engagement agreement. Either party may end an engagement for material breach if the breach is not fixed within 15 days of written notice. Fees earned through the termination date remain payable. Sections 5, 6, 8, 9, 10 and 12 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute will be resolved only in the state or federal courts in Williamson County, Tennessee, and you consent to jurisdiction there. Before filing any formal action, both parties will try in good faith to resolve the dispute directly.

13. Changes to these Terms

We may update these Terms from time to time. We will post the update here and change the “Last updated” date above. Continuing to use our website or services after an update means you accept it.
